INCOME TAX PREPARATION SERVICE AGREEMENT


This agreement is made between Tax Craze (known in this contract as “Preparer”) and Signers (known in contract as "Client", “Tax Payer” and “You” referring to you and your spouse, if applicable, and any dependent on the tax return or other person who provides tax information) to prepare your federal and state individual income tax returns and/or business tax return.

Documents/Forms. These returns will be prepared from information which you will furnish to Preparer. Preparer will not audit or make any other verification on the data you submit, although it may be necessary to ask you for clarification of some of the information. Preparer will furnish you with a checklist to help you in gathering the necessary information. Please note this list is not comprehensive, and any forms you are unsure about should be submitted to Preparer prior to Preparer preparing your tax forms. In the event of an audit by a taxing authority, Client will be required to provide the documentation for all items in question to the taxing authority. It is the taxpayer’s (your) responsibility to obtain/retain all documentation that supports your tax liability.

Retainer. Client agrees to pay a non-refundable retainer of $60.00 (sixty dollars) to Preparer prior to starting any work. This retainer will be credit to the balance owed to the Preparer once job has been completed.   

Hard Copy Taxes. Client may request one (1) printed copy of tax return at no additional cost. Client agrees to pick up their tax return and supporting forms from Preparer within thirty (30) days of being notified by Preparer that taxes have been completed. Please provide notice to your preparer that you plan to pick up your taxes. Failure to do so will result on Client forfeiting their printed prepared taxes. Any additional copies will be an extra $5 per tax year.

E-Filing Taxes. Client agrees to sign their tax returns within three (3) business days of being notified by Preparer that taxes have been completed. Failure to do so will result on Client forfeiting their prepared taxes and any monies paid unless any prior agreement has been arranged in writing (text or email is acceptable).

Records. It is the Clients responsibility to provide all the information required for the preparation of a complete and accurate tax return. You should retain all documents, cancelled checks and other data that form the basis of income and deductions for at least the period of the statute of limitations (typically 3 years, but can unlimited in certain situations). You should also retain documents that support items carried over into open years, such as cost basis information, nondeductible IRA's, net operating losses, etc. This information may be necessary to prove the accuracy and completeness of the returns to a taxing authority. You have the final responsibility for the income tax returns; therefore, you should review them carefully before you sign them.

IRS Delivery. If for some reason you believe your returns have not been received by the taxing authorities, (i.e., didn't get your refund or they haven't cashed your check) then please contact the Preparer.

Errors and Omissions. Preparer’s work in connection with the preparation of your income tax returns does not include any procedures designed to discover errors or omissions by you, fraud, misrepresentations, defalcations and/or other irregularities, should any exist. Preparer will render such accounting assistance as determined to be necessary only for the preparation of your income tax returns. It is your responsibility to provide Preparer with accurate, truthful information for use in preparing your tax forms.

Law. Preparer will use their professional judgment in resolving questions where the tax law is unclear, or where there may be conflicts between the taxing authority’s interpretation of the law and other supportable positions. The law provides various penalties that may be imposed when taxpayers understate their tax liability. The Internal Revenue Service also imposes penalties upon taxpayers and return preparers for failure to observe due care in reporting for income tax returns.

Adjustments. Your returns may be selected for review for any reason by the taxing authorities. Any proposed adjustments by the examining agent are subject to certain rights of appeal. In the event of such government tax examination, Preparer will be available upon request to help Client resolve these issues. However, such assistance is not included in your tax preparation fee and your Preparer will render additional fees for the time and expense incurred on a case-by-case basis. Moreover, the taxing authorities may correspond with you (the Client) regarding your tax return. Client agrees to timely forward this correspondence to Preparer for review and analysis. Additional fees may be charged depending upon the response required.

Fees. Preparer fees will be discussed with Client prior to providing services. It is the Client’s responsibility to ask about these fees. The Preparer fees are based upon the amount of time spent and complication of the forms. Payment for services is due and payable upon presentation via Zelle, Venmo or Credit card (merchant). No check will be accepted.

Filing. Unless otherwise specified by Client in writing (email is sufficient), Preparer will create/generate a PIN for Client that will be used as their signature on their tax forms (applies to all electronically filed tax forms). No return can be e-filed without receipt of signed Form 8879.

Forms to Preparer. All tax documents must be hand delivered, sent via USPS (with tracking) or other carrier, emailed or uploaded to a secure portal (such as dropbox). Due to the sensitivity of the records, emailing these documents is not recommended but it is on the discretion of the client.

Amendment. Client understands that amended tax returns are a separate cost. Client will request a quote from Preparer prior to any work being done.  

E-File Copy. Electronic copy of income taxes will be emailed or text securely at the Client’s contact information at no additional cost.

Timeline. Preparer will deliver income tax returns between 2 to 5 business days upon a complete file/documents furnished by the Client. Any delays will be communicated with the client in advance.

Form of Payment. Preparer will accept cash, Zelle @ carla@taxcraze.com, Venmo @taxcraze or Merchant by visiting https://taxcraze.com/payment.

Discrepancy. The Client agrees to acknowledge the services being provided by the Preparer, in a dignified and respectful manner and if there is any discrepancy regarding services of Preparer, the Client must submit a full written report to Tax Craze immediately in order for the parties involved to reach a mutually acceptable resolution. If both parties involved continue to disagree then a mediator will be used. Furthermore, Client agrees to not post negative reviews on the internet (or elsewhere) or to make negative verbal or written statements until all efforts to resolve said discrepancy have been exhausted.

Limited Liability Cause. Client agrees to indemnify and hold harmless Preparer of and from any and all claims, demands, losses, causes of action, damage, lawsuits, judgments, including attorneys' fees and costs, to the extent caused by or arising out of or relating to the work of the Preparer. In no event shall the maximum liability hereunder exceed the amount actually paid to Preparer under this contract. Any disputes or arbitration with respect to this contract shall be held only in the State of California within Riverside County, in accordance with California law.
